1. Acceptance of Terms

Welcome to www.khilonaa.com (the "Site", "Platform"), owned and operated by Techno Be With You, a proprietorship firm having its registered office and warehouse at Plot 379, Second Floor, Sector 68, IMT Faridabad, Haryana – 121004, India ("Khilonaa", "Company", "we", "us", "our").

These Terms & Conditions ("Terms") govern your access to and use of the Site and your purchase of products offered by us, whether through the Site or otherwise (collectively, the "Services"). By accessing, browsing, or otherwise using the Site — including by clicking "I Accept," "I Agree," or a similar option, where provided — you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, Shipping Policy, and Return & Refund Policy (together, the "Policies"), each of which is incorporated by reference into these Terms.

If you do not agree with any part of these Terms, please discontinue use of the Site immediately.

We reserve the right to update, amend, or modify these Terms at any time, at our sole discretion, without prior notice. Changes take effect immediately upon posting on the Site, and the "Last Updated" date will reflect the most recent revision. Your continued use of the Site following any such change constitutes your acceptance of the revised Terms.

2. Eligibility

• Khilonaa sells intimacy and sexual wellness products intended strictly for adult use. Use of the Site is restricted to individuals who are at least 21 (twenty-one) years of age and who are competent to enter into a legally binding contract under the Indian Contract Act, 1872.

• Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 — including minors, undischarged insolvents, and persons of unsound mind — are not permitted to access, browse, register on, or transact on the Site.

• By accessing or using the Site, you represent and warrant that you are at least 21 years of age and legally competent to enter into a binding contract.

• We do not knowingly collect data from, or sell to, individuals below 21 years of age. If we become aware that a person below this age has registered or transacted on the Site, we reserve the right to immediately terminate that account and cancel any associated orders, without liability to Khilonaa.

• You are solely responsible for ensuring your use of the Site complies with the laws applicable in your jurisdiction, including any restrictions relating to the purchase, possession, or import of adult wellness products.

3. Account Registration

• To place an order, you may be required to register an account on the Site by providing accurate information such as your name, email address, phone number, and delivery address, or you may check out as a guest, where this option is made available.

• You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to notify us immediately at customercare@khilonaa.com if you suspect any unauthorized use of your account.

• You agree that all information you submit is true, accurate, current, and complete, and you agree to promptly update it as needed. We are not responsible for any loss, delay, or error arising from inaccurate or outdated information provided by you.

• We reserve the right to suspend, disable, or terminate any account, at our sole discretion, if we believe these Terms have been violated, or for any other reason, with or without notice.

• You may request deletion of your account at any time by writing to customercare@khilonaa.com.

4. Discreet & Personal Nature of Products

Given the intimate nature of our products, please note:

• All products are strictly for personal, non-commercial use and are not intended for resale.

• Products are shipped in plain, discreet, unbranded packaging with no external indication of the contents, and invoices/order details are kept confidential to the extent possible.

• Given hygiene and safety considerations inherent to personal-use intimacy products, our Return & Refund Policy applies distinct terms to these products (see Section 8 and our separate Return & Refund Policy).

5. Product Information & Pricing

• We make reasonable efforts to ensure that product descriptions, images, specifications, and pricing displayed on the Site are accurate. However, we do not warrant that this information is complete, current, or error-free. Product images are indicative; actual colour, size, or packaging may vary slightly due to manufacturing or display/screen differences.

• We reserve the right, at our sole discretion, to correct any errors, inaccuracies, or omissions, and to change or update information (including pricing) at any time without prior notice, including after an order has been placed.

• In the event a product is mistakenly listed at an incorrect price due to a typographical, technical, or pricing error, we reserve the right to cancel the order, refund any amount already charged, and notify you of the same.

• All prices listed on the Site are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated. Payments for orders can only be made in INR.

6. Payment

• Payments on the Site are processed through our third-party payment gateway partner, Gokwik, and other integrated payment methods (credit/debit cards, UPI, net banking, and wallets, as made available).

• By submitting your payment details and placing an order, you authorize Khilonaa and its payment processing partner(s) to charge the applicable amount to your selected payment method.

• Khilonaa is not responsible for the security practices, technical performance, or any transaction failure, delay, or data handling of the third-party payment gateway. Any issues relating specifically to the payment method itself (e.g., your bank, card issuer, or UPI provider) should be directed to that provider.

• Our obligation to fulfil an order arises only once payment has been successfully received and the order is confirmed by us.

• You agree not to hold Khilonaa responsible for any bank charges, transaction fees, or currency conversion charges incurred in connection with payments made on the Site.

7. Shipping & Delivery

Full details are set out in our separate Shipping Policy, which is incorporated into these Terms by reference. In summary:

• We currently ship only within India; international shipping is not available.

• Orders are delivered within 4–5 business days, excluding public/national holidays, subject to serviceability of the delivery location and other factors beyond our reasonable control.

• All products are shipped in discreet, unbranded packaging as described in Section 4.

8. Warranty, Returns, Exchange & Refunds

Full details are set out in our separate Return, Refund & Cancellation Policy, which is incorporated into these Terms by reference. In summary:

• Applicable products carry a 3-month limited warranty from the date of purchase, covering manufacturing defects, subject to the exclusions listed in that Policy.

• Owing to the personal and intimate nature of our products, we do not accept returns or offer refunds once a product has been delivered, except as expressly stated below.

• If you receive a wrong or visibly damaged/defective product, you must notify us at customercare@khilonaa.com with an unboxing video within 24 hours of delivery. Valid claims will be processed for exchange only (no cash refund), and the replacement will be shipped within 7–10 business days, excluding public/national holidays.

• No refunds, returns, or exchanges will be entertained without the required video evidence submitted within the specified window.

9. Health, Safety & Product Use Disclaimer

• Khilonaa's products are not medical devices, and do not carry any medicinal or therapeutic claims.

• Any general information provided on the Site relating to intimacy, pleasure, or wellbeing is for general informational purposes only and does not constitute, and should not be relied upon as, professional medical or psychological advice.

• You are advised to carefully read individual product instructions, care guidelines, and ingredient/material information prior to use, and to discontinue use immediately and consult a qualified healthcare professional if you experience any discomfort, irritation, or adverse reaction.

• Khilonaa shall not be liable for any injury, allergic reaction, or adverse effect arising from improper use, failure to follow product instructions, or use of the product in a manner inconsistent with its intended purpose.

10. Rules of Conduct / Prohibited Use

While using the Site, you agree that you shall not:

• Use the Site for any unlawful purpose or in violation of these Terms or any applicable law;

• Upload, post, or transmit any content that is obscene beyond the platform's intended adult-wellness context, defamatory, harassing, hateful, discriminatory, or that violates any third party's rights;

• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;

• Attempt to gain unauthorized access to the Site, other users' accounts, or any connected systems or networks;

• Transmit any virus, malware, or other harmful code, or otherwise interfere with the proper functioning of the Site;

• Use any automated means (bots, scrapers, crawlers) to access or extract data from the Site without our prior written consent;

• Engage in any activity that threatens the unity, integrity, security, or sovereignty of India, or that is otherwise contrary to applicable law.

We reserve the right, at our sole discretion, to suspend or terminate access to any user who violates these rules, and to report unlawful activity to the appropriate authorities.

11. Intellectual Property

• All content on the Site — including the Khilonaa name, logo, trademarks, product images, graphics, text, layout, design, and other materials (collectively, "Content") — is the exclusive property of Khilonaa (Techno Be With You) or its licensors and is protected under applicable Indian copyright, trademark, and intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content solely for personal, non-commercial use.

• You may not copy, reproduce, republish, distribute, modify, create derivative works from, or commercially exploit any Content without our prior written consent.

• Any unauthorized use of Khilonaa's intellectual property may result in legal action.

12. Brand Impersonation Disclaimer

Khilonaa is the exclusive and official brand operating this Site at www.khilonaa.com. We are not affiliated with, and are not responsible for, any copycat, counterfeit, or impersonating websites, social media accounts, or sellers claiming to represent Khilonaa. Please ensure that you transact only through our official Site and any channels explicitly authorized by us. Transactions made through unauthorized platforms are entirely at your own risk, and Khilonaa shall not be liable for any resulting loss, fraud, or dissatisfaction.

13. Third-Party Links & Services

The Site may contain links to third-party websites or services (including our payment gateway partner). These links are provided for convenience only and do not constitute an endorsement by Khilonaa. We do not control and are not responsible for the content, privacy practices, or terms of any third-party site. Any interaction with such third parties is solely between you and them, at your own risk.

14. Limitation of Liability

To the fullest extent permitted by applicable law:

• The Site and all Content, Services, and products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

• Khilonaa, its proprietor, employees, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site or products, including but not limited to loss of data, loss of profit, or any harm resulting from reliance on information provided on the Site.

• Khilonaa's aggregate liability for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount actually paid by you for the specific product or order giving rise to the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless Khilonaa (Techno Be With You), its proprietor, employees, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or connected to: (a) your breach of these Terms; (b) your violation of any applicable law; (c) your infringement of any third-party right; or (d) your misuse of the Site or products.

16. Termination

We reserve the right to suspend or terminate your access to the Site or any account, without prior notice, at our sole discretion, including for violation of these Terms. Upon termination, all provisions of these Terms that by their nature should survive (including intellectual property, limitation of liability, indemnification, and governing law) shall continue to apply.

We will endeavour to acknowledge grievances within 24–48 hours and resolve them within a reasonable timeframe as required under applicable law.

18. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to Section 20 below, the courts at Faridabad, Haryana shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms, the Site, or your use of the Services.

20. General Provisions

• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

• No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

• Entire Agreement: These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Khilonaa regarding your use of the Site, superseding any prior agreements or communications.

• Force Majeure: Khilonaa shall not be liable for any delay or failure to perform its obligations due to causes beyond its reasonable control, including natural disasters, strikes, pandemics, government restrictions, or network/technical failures.
